Separation Agreement
If you are dealing with your separation or divorce through mediation, your mediator will recommend that you have access to independent legal advice throughout the process.

Mediators are not permitted to offer legal advice, so you will need to be able to discuss things with a solicitor who is on your side before you make any decisions.

Because you may only get one shot at mediation, you want to make the most of it. As a solicitor who is also a certified mediator, I can offer you the legal advice you need, while also providing you with coaching, so that you can be sure that your voice is heard and that your time in mediation is effective.

This service will help you to retain your control and your independence, with the support of an independent solicitor who understands mediation, and whose role is to make sure that your interests are protected.

The service comprises:

  • Preliminary consultation to prepare you for mediation
  • Legal support: information and advice, when you need it, as mediation progresses
  • Mediation support: coaching in negotiation skills and helping you to find your voice in mediation
  • Legal analysis of your mediated Separation Agreement
  • Concluding consultation: Identifying your next steps and long-term plans, and future-proofing your Separation Agreement

This service will provide you with the support you need to negotiate the terms of your separation with confidence, by providing access to a solicitor who is also a mediator, with whom you can discuss both the mediation process and the legal implications of separation. As a mediator, I can provide you with support and “coaching” to ensure that your voice is heard and that you get the most out of every mediation session. As a solicitor, I can answer your questions about the legal implications of every decision you are faced with, as you go along. We will have face-to-face consultations at the beginning and at the end of the process, and we can talk on the phone or in the office between your mediation sessions, as your needs dictate. I will be here to support your independence.

What follows is a detailed description of the service:

  • Preliminary consultation to prepare you for mediation 

Having taken some introductory details from you on the phone, we will arrange to meet for a pre-mediation consultation. We will spend up to ninety minutes talking together, and I will answer whatever questions you have.

The preliminary session will typically deal with questions like these:

-          How does mediation work?

-          What is the role of the mediator?

-          What if my voice is not heard?

-          What should I do if I am not sure about a decision I am asked to make?

-          Why am I required to receive independent legal advice?

-          What matters will the mediated agreement deal with? 

  • Legal support: information and advice, when you need it, as mediation progresses

and

  • Mediation support: coaching in negotiation skills and helping you to find your voice in mediation

Your mediation will typically take between three and six sessions of around one hour each time. Each session will present its own challenges and questions. As legal questions arise, you may wish to pick up the phone and ask me a quick question. In some cases it may suit you better to email or to chat online… or you may prefer to call into the office. Either way, I will be happy to speak with you between every mediation session, to answer your legal questions and to provide advice about the legal implications of any decision you are considering.

There may be times when you worry that your voice is not being heard. You may wish to seek advice about how to negotiate effectively, to ensure that you reach agreements that are sustainable and fair. The support that you need to overcome these difficulties will often be best provided in face-to-face meetings. As a trained mediator, I will be able to help you to identify and practice useful strategies, so that you will get the most out of the time you spend in mediation.

Whichever way you prefer to communicate, I will be at your disposal as a legal advisor and as a mediation coach for up to ninety minutes each week for as long as your mediation continues.

  • Concluding consultation: Identifying your next steps and long-term plans, and future-proofing your Separation Agreement

When your mediated agreement is finalised, I will examine it in order to prepare an analysis for you of the potential future implications of each element of the agreement, for example how it is likely to affect any future Divorce application.

That analysis of your mediated agreement, as well as all that you have told me in the previous weeks, will provide the basis for the concluding consultation. At that meeting, we will sit down together to look through each and every element of your mediated agreement, to identify whether you will need to formalise it by means of a Deed of Separation or a Judicial Separation, and if so, what your next steps should be.

Costs – inclusive of all taxes and charges: 

Pre-mediation consultation

+ legal and mediation support consultations

+ legal analysis of mediated agreement and concluding consultation

We will fix the price first, so that you know how exactly much you will need to budget for. Depending on the number of weeks that you spend in negotiation, and the amount of consultations that you wish to have, the cost will be between €500.00 and €950.00.

For example, the basic package of €500.00 covers the initial and closing advice sessions, with three scheduled consultations during mediation, while the full service for €950.00 provides extensive support as you need it during the weeks you are in mediation.

Should you choose to pay the full amount or a portion of the amount in advance, you will receive a 10% discount on the amount paid. Alternatively, you may prefer to set up a monthly standing order so that you can spread the payments out in a way that suits you.

You will need to feel comfortable with me! If you decide following the pre-mediation consultation that I am not the right person to provide the kind of support you need, you will not be under any obligation to continue, and any fees you have paid for services not yet provided will be immediately refunded in full.
